1. What MealMesh is

MealMesh is a software platform that connects kitchens (home cooks, tuck shops, school meal programmes, and similar vendors) with customers who browse menus and place meal orders. MealMesh tracks proof of payment (POP) uploads. Payment is opt-in per kitchen. When a kitchen opts in, CAG Trading (Pty) Ltd collects the full meal payment from the customer through PayFast and pays the kitchen's portion out once a week, minus commission (R2 per meal). Kitchens that do not opt in are paid directly by the customer (for example by EFT).

2. Platform role

MealMesh is not a party to the sale of food between a kitchen and a customer. The contract for the meal is between those parties. MealMesh provides ordering, POP tracking, notifications, and related tools. For kitchens that opt in to PayFast collection, CAG Trading (Pty) Ltd acts as the payment collector on the kitchen's behalf. A per-meal commission (R2 per meal) is payable by the kitchen to CAG Trading (Pty) Ltd as described during kitchen registration and in invoices.

3. Kitchen responsibilities

Kitchens are responsible for food quality, hygiene, and compliance with applicable food-safety and business laws. Kitchens must honour menus, prices, pickup or delivery options they offer on MealMesh, and handle payment arrangements with their customers. Kitchens that opt in to PayFast collection agree that CAG Trading (Pty) Ltd collects payments on their behalf and pays out weekly. Kitchens must honour refunds for problems they cause and must respond to complaints within 24 hours. Kitchens must keep their R638 Certificate of Acceptability valid.

Food safety certification: You warrant that you hold a valid Certificate of Acceptability (Regulation R638) from your local municipality, or will obtain one before selling meals through MealMesh, and that you comply with all applicable food-safety and hygiene requirements. You must keep this certificate valid for as long as you use MealMesh.

4. Customer responsibilities

Customers must provide accurate account and order information, pay the kitchen as instructed (including uploading proof of payment where required), and collect or receive meals according to the fulfilment option chosen.

5. Payments and proof of payment

For kitchens that have not opted in to PayFast collection, payment is made directly to the kitchen. MealMesh only helps record and verify proof of payment files. Rejection or acceptance of a POP is decided by the kitchen. For kitchens that have opted in, CAG Trading (Pty) Ltd collects payment through PayFast on the kitchen's behalf and pays out weekly minus commission (R2 per meal). CAG Trading (Pty) Ltd is the PayFast merchant. MealMesh is not a payment service provider.

6. Commission

Kitchens agree that CAG Trading (Pty) Ltd may charge a commission of R2 per meal ordered, as shown at registration and on platform invoices. Commission applies to each meal portion ordered (extras and delivery fees excluded). If an order is cancelled before your kitchen order cutoff for that meal, no commission is charged for that order; cancellations at or after that cutoff still count. No commission is charged on orders fully refunded because of a kitchen fault. Customers are not charged a MealMesh commission for using the ordering tools.

7. Limitation of liability

Nothing in these terms limits your rights under the Consumer Protection Act 68 of 2008 (CPA), including your rights to safe, quality goods (CPA s55), implied warranty of quality (CPA s56), and liability for harm caused by unsafe goods (CPA s61). MealMesh provides the platform as available and aims for reliability but does not guarantee uninterrupted access. MealMesh is not liable for late or missed pickups or deliveries, kitchen payment disputes, or losses arising from how a kitchen or customer uses the platform, except where such liability cannot be excluded under the CPA.

8. Governing law

These terms are governed by the laws of the Republic of South Africa. If a dispute cannot be resolved informally, South African courts have jurisdiction.
